RISK OF LOSS
All items purchased from HOQS Australia are made pursuant to a shipment contract.
This basically means that the risk of loss and title for such items pass to you upon
our delivery to the carrier.
PRODUCT DESCRIPTIONS
HOQS Australia and its associates attempt to be as accurate as possible. However,
HOQS Australia does not warrant that product descriptions or other content of this site
is accurate, complete, reliable, current, or error-free. If a product offered by
HOQS Australia itself is not as described, your sole remedy is to return it in unused
condition.
Australian consumer law grants the rights for sellers to make aware defects or problems which may affect what is considered "Acceptable quality", HOQS Australia will declare defects on loudspeaker drivers which would be considered, "Scuffs", "Buffs", "Scratches", "Paint or Anodizing nonuniformity", "Chips to ferrite magnets", "Chips to external faces of powder coated areas", and general superfisial cosmetic defections that do not adversely affect either product operator or product performance.
Example photos of such will be in the descriptions of products that are affected by it.
While manufacturing is done with care, construction with raw or outsourced materials cannot guarantee that the material is 100% defect free, this is especially the case with ferrite magnets due to their fragile makeup and multiple instances of handling throughout the raw manufacturing stage, to assembly lines, and transport.
The HOQS Loudspeakers and speaker components are not manufactured by HOQS Australia, loudspeaker drivers are designed by HOQS Global and manufactured by an OEM.

APPLICABLE LAW

Australia, without regard to principles of conflict of laws, will govern these
Conditions of Use and any dispute of any sort that might arise between you and
HOQS Australia or its associates.
DISPUTES
Any dispute relating in any way to your visit to HOQS Australia or to products you
purchase through HOQS Australia shall be submitted to confidential arbitration in
Queensland, Australia, except that, to the extent you have in any
manner violated or threatened to violate HOQS Australia's intellectual property rights,
HOQS Australia may seek injunctive or other appropriate relief in any state or federal
court in the state of Queensland, Australia, and you consent to
exclusive jurisdiction and venue in such courts. Arbitration under this agreement
shall be conducted under the rules then prevailing of the American Arbitration
Association. The arbitrators award shall be binding and may be entered as a
judgment in any court of competent jurisdiction. To the fullest extent permitted by
applicable law, no arbitration under this Agreement shall be joined to an arbitration
involving any other party subject to this Agreement, whether through class arbitration
proceedings or otherwise.
